In terms of the Protection of Personal Information Act (POPIA), the justification ground which we base our processing on consist out of the following:

  • The processing is necessary to carry out actions for the conclusion or performance of a contract to which the data subject is a party;
  • The processing complies with an obligation imposed by law on the business;

We keep Company information for the duration of your Service Level Agreement or until such time all services are cancelled by you. We will then dispose your information by deleting all digitally stored information as well as shredding all hard copies.

How we safeguard you data:

We acknowledge that security requirements are constantly changing and that effective security requires frequent evaluation and regular improvements of outdated security measures. The Operator will therefore evaluate the measures as implemented on an on-going basis in order to maintain compliance with the requirements set out in POPIA.

We shall promptly notify the Responsible Party of any planned permanent or temporary transfers of personal information to a third country, without an adequate level of protection, and shall only perform such a transfer after obtaining authorisation from the Responsible Party, which may be refused at its own discretion.

Operator shall:

  • 1. Ensure that the personal information can be accessed only by authorized personnel for the purposes set forth in Annexure 2 of this Data Processing Agreement;
  • 2. Take all reasonable measures to prevent unauthorized access to the personal information through the use of appropriate physical and logical (passwords) entry controls, securing areas for information processing, and implementing procedures for monitoring the use of information processing facilities;
  • 3. Build in system and audit trails;
  • 4. Use secure passwords, network intrusion detection technology, encryption and authentication technology, secure logon procedures, and virus protection;
  • 5. Account for all the risks that are presented by processing, for example from an accidental or unlawful destruction, loss, or alteration, unauthorized or unlawful storage, processing, access or disclosure of personal information;
  • 6. Ensure pseudonymisation and/or encryption of personal information, where appropriate;
  • 7. Maintain the ability to ensure the ongoing confidentiality, integrity, availability, and resilience of processing systems and services;
  • 8. Maintain the ability to restore the availability and access to personal information in a timely manner in the event of a physical or technical incident;
  • 9. Implement a process for regularly testing, assessing, and evaluating the effectiveness of technical and organisational measures for ensuring the security of the processing of personal information;
  • 10. Monitor compliance on an ongoing basis;

Confidentiality

The Company will:

  • treat your personal information as strictly confidential;
  • take appropriate technical and organizational measures to ensure that your personal information is kept secure and is protected against unauthorized or unlawful processing, accidental loss, destruction or damage, alteration, disclosure, or access;
  • Promptly notify you within a reasonable time, if we become aware of any unauthorized use, disclosure or processing of your personal information;

Your data protection rights:

  • You are entitled to access your personal data by sending a written request to Juan-dre Botha We may charge you a fee for this service as set out in terms of Condition 8 of POPIA.
  • You may also request IT Trust to correct or supplement any of your personal data which IT Trust will undertake as soon as practicable.
  • Request the destruction of your personal data. IT Trust will consider your request in light of any other laws or regulations prohibiting IT Trust from destroying your personal data.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
